Other than this, if you have children in the marriage then you need to prepare a child custody and support plan and provide them to the court while appearing for the divorce hearing. If the court finds these plans good enough then they are accepted by the court and the divorce is granted. But if you go for a contested divorce then things don't go so easily. I am having a difficult time with my divorce. My husband was arrested (with my help) for molesting my granddaughter (5). His mother took his power of attorney and is suing me for divorce (also evicted me from the home which was bought with my money premarital, yet put in his name due to credit problems). I am getting no cooperation from that side, and have a pro bono attorney who is not thrilled about doing anything but the basics. He is in state prison for 5-10 years, so what are his legal rights to any marital posessions with his mother being the POA? Meddling mother in laws should not be in charge of my divorce with him, but she is.
